Terms of Service
Rental terms for Fallcrest Portable Toilets: quotes, delivery and access, service schedules, responsibilities, damage, cancellations and billing.
These terms apply to portable restroom rentals provided by Fallcrest Portable Toilets. Booking a rental means you accept them. A signed rental agreement, when used, takes precedence where the two differ.
Quotes and booking
Quotes are based on the unit type, rental length, service frequency and delivery distance you describe. Changes to the site, dates, unit count or access may change the price. Availability of specialty units such as restroom trailers and ADA units is confirmed at the time of booking.
Delivery, placement and access
You are responsible for providing safe, legal access and for identifying a placement area on firm, level ground within reach of our service vehicle. You are responsible for any required permits or property owner permission. We are not liable for ordinary surface marks on grass, gravel or driveways caused by normal delivery and service.
Service
Scheduled service includes pumping, rinsing, sanitizing, deodorizing and restocking of standard supplies. If access is blocked at the time of a scheduled visit, the visit may be billed as attempted and rescheduled at the next available opportunity.
Customer responsibilities
- Keep the approach path clear, including snow removal in winter
- Do not move or relocate units yourself; call us and we will move them
- Do not place hazardous materials, paint, solvents or debris in the tank
- Notify us promptly of damage, tipping or vandalism
Damage and loss
Units remain our property throughout the rental. You are responsible for damage beyond normal wear, including vandalism, tipping caused by improper placement requests, and loss. We will always discuss any damage charge before invoicing.
Cancellations and changes
Cancellations made before dispatch are not charged. Once a unit is loaded or delivered, delivery and pickup costs may apply. Early pickups do not automatically prorate short-term event rentals.
Billing
Event rentals are typically billed as a single term. Long-term rentals are billed on a recurring cycle that includes scheduled service. Invoices are due per the terms shown on the invoice; late balances may pause service.
Limitation of liability
Our liability for any claim is limited to the amount paid for the rental giving rise to the claim. We are not liable for indirect or consequential losses, including lost revenue from an event or project delay.
Governing law
These terms are governed by the laws of the State of South Dakota.
